PRIVACY POLICY

OVERVIEW

This Privacy Policy describes how O2 Treehouse Commercial Inc. ("O2 Treehouse," "we," "us," or "our") collects, uses, and shares your personal information when you visit or make a purchase from our online store at shop.o2treehouse.com, and when you use our other websites, forms, newsletters, and booking pages (together, the "Site"). Our websites include www.o2treehouse.com, www.treewalkers.world, equilibriumarchitectural.com (Equilibrium Homes), pineconetreehouse.com (Pinecone), www.o2treehousefoundersclub.com (Moonhaven), and our Pinecone Treehouse booking site powered by Guesty.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform that lets us sell our products to you.

PERSONAL INFORMATION WE COLLECT

Device Information. When you visit the Site, we automatically collect information about your device, such as your web browser, IP address, time zone, approximate location (city or region), and some of the cookies installed on your device. As you browse, we also collect the pages and products you view, the websites or search terms that referred you, and how you interact with the Site. We collect Device Information using:

  • Cookies: small data files placed on your device, often containing an anonymous unique identifier. To learn how to manage or disable cookies, visit www.allaboutcookies.org.

  • Log files: records of actions on the Site, including your IP address, browser type, internet service provider, referring and exit pages, and date and time stamps.

  • Web beacons, tags, and pixels: small files that record how you browse the Site and whether you open our emails.

Order Information. When you buy or try to buy from our online store, we collect your name, billing and shipping addresses, email address, phone number, items ordered, and payment information. Payment card details are entered directly with Shopify and its payment processors; we never receive or store full card numbers. If you report a defective item, we also collect the photos and details you send us.

Reservation Information. When you book a stay at the Pinecone Treehouse through our Guesty booking site, we collect your name, email address, phone number, billing details, stay dates, number of guests, and messages with our hosts. Payment is collected in full by card when your booking is confirmed and is processed by Stripe.

Inquiry Information. When you fill out one of our forms, request a quote or consultation, ask about investing, apply for a job, or email us, we collect your name, contact details, company, and the information you choose to share, such as project location, photos, plans, budget, and timeline.

In this Privacy Policy, "Personal Information" means Device Information, Order Information, Reservation Information, and Inquiry Information. Please do not send us sensitive information such as government ID or bank account numbers through the Site.

OPTING INTO MARKETING COMMUNICATIONS

You can choose to receive our newsletter and updates about our treehouses, collections, stays, and events by signing up through a form or popup on the Site, or by checking the marketing box at checkout in our online store. We use the information you give us to send you email updates and marketing.

Our forms and newsletters run on monday.com. When you submit one of our forms, the information you provide is transferred to monday.com and processed under its Privacy Policy. Marketing preferences you give at checkout are stored by Shopify.

You can change your mind at any time by clicking the unsubscribe link at the bottom of any email from us or by emailing info@o2treehouse.com. We will still send you messages about your orders, reservations, and inquiries. If we send you text messages, we will do so only with your consent, and you can reply STOP to opt out.

TEXT MESSAGES (SMS)

How you opt in. You can choose to receive text messages from O2 Treehouse by checking the SMS opt-in box on our online forms, or on a sign-up form in one of our ads on Facebook, Instagram, or Google. When you submit a form in one of these ads, Meta or Google sends us the information you enter, such as your name, email address, phone number, and whether you agreed to receive texts. Likewise, when you submit one of our online forms with your phone number and the SMS opt-in box checked, our forms platform (monday.com) records your name, phone number, the date of your submission, and your agreement to receive texts. If we meet you in person, for example at an event, tour, or site visit, we will ask for your permission before texting you and will keep a record of your name, phone number, and the date you agreed. You do not have to agree to receive texts to buy from us, book a stay, or work with us.

What we send. We may text you about your inquiry, project, quotes, consultations, orders, and Pinecone Treehouse reservations, and, if you have agreed to marketing texts, news about our treehouses, collections, stays, events, and offers. Message frequency varies. Message and data rates may apply.

How to opt out. Reply STOP to any message to stop receiving texts, and we will send one final message confirming you have been unsubscribed. Reply HELP for help, or contact us at info@o2treehouse.com or (707) 204-0119. Wireless carriers are not liable for delayed or undelivered messages. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes using Twilio SMS services.

Your mobile information. We do not sell, rent, or share your mobile phone number or text messaging consent with third parties or affiliates for their marketing or promotional purposes. We share this information only with the service providers that help us send text messages, such as [SMS platform], and only to deliver our messages to you.

SMS Terms of Service

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use Order Information to fulfill orders placed through our online store, including processing payments, producing print-to-order items, arranging shipping, sending invoices and order confirmations, and handling returns of defective items.

We use Reservation Information to confirm and manage Pinecone Treehouse stays, collect payment, send invoices, and communicate with you before, during, and after your stay.

We use Inquiry Information to answer your questions, prepare quotes and proposals, schedule consultations, respond to investor inquiries, and review job applications.

We also use Personal Information to:

  • communicate with you;

  • screen orders and bookings for potential risk or fraud;

  • send you information or advertising about our products and services, in line with the preferences you have shared with us;

  • comply with legal, tax, and accounting obligations; and

  • protect the rights, property, and safety of O2 Treehouse, our customers, and others.

We use Device Information to screen for risk and fraud (in particular, your IP address) and to improve and optimize the Site, for example by generating analytics about how visitors browse and interact with the Site and by measuring the success of our marketing and advertising campaigns.

SHARING YOUR PERSONAL INFORMATION

We share Personal Information with companies that help us run our business and use your information as described above. They may use it only to provide services to us. O2 Treehouse is not responsible for how these 3rd party companies use your information. Please refer to the 3rd party privacy policies below.

We may also share Personal Information with architects, engineers, contractors, and installers working on a project you have asked us to quote or build; with our lawyers, accountants, and insurers; with a buyer or successor if we merge, sell, or reorganize all or part of our business; and with others when you ask us to.

Finally, we may share Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request, or to otherwise protect our rights.

We do not sell your Personal Information for money.

BEHAVIORAL ADVERTISING

We use Personal Information to show you targeted ads and marketing we believe may interest you. To do this, we work with advertising partners, including Meta (Facebook and Instagram), Google, and Microsoft (Bing), whose cookies and pixels on the Site collect information about your browsing and purchases. Under California law, this may be considered "sharing" your Personal Information for cross-context behavioral advertising. To learn how targeted advertising works, visit the Network Advertising Initiative's page at networkadvertising.org.

You can opt out of targeted advertising by:

  • choosing "Decline all" or "Manage cookies" in our cookie banner, or using the "Cookie Preferences" button;

  • turning on Global Privacy Control in your browser;

  • adjusting your settings with each platform: Meta, Google, and Microsoft; or

  • visiting the Digital Advertising Alliance's opt-out portal at optout.aboutads.info.

COOKIES

We use strictly necessary cookies to run the Site, process checkout, and prevent spam; functional cookies to remember your choices; analytics cookies (Squarespace Analytics, Shopify analytics, and Google Analytics) to understand how the Site is used; and advertising cookies and pixels (Meta, Google Ads, and Microsoft Advertising) to measure and personalize ads.

When you first visit the Site, a cookie banner lets you accept all cookies, decline all non-essential cookies, or choose by category. Non-essential cookies are not placed until you make a choice, and you can change it any time with the "Cookie Preferences" button. Our online store manages cookie choices through Shopify. You can also block or delete cookies in your browser settings, though some parts of the Site may not work properly.

DO NOT TRACK AND GLOBAL PRIVACY CONTROL

Because there is no common industry standard for "Do Not Track" signals, we do not change our data practices when we receive one. We do treat a Global Privacy Control (GPC) signal from your browser as a request to opt out of the sale or sharing of your Personal Information for that browser.

YOUR RIGHTS

California residents. Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, you have the right to:

  • know what Personal Information we have collected about you, where it came from, why we use it, and whom we share it with;

In the past 12 months, we have collected identifiers (such as name, email, phone, and IP address), customer records (addresses and billing details), commercial information (purchases, stays, and products you asked about), internet activity, approximate location, professional or employment information, photos you send us, and inferences about your interests. We collected this information from you, your device, and the providers listed above, for the purposes described in this Policy, and disclosed it to those providers. We have shared identifiers, commercial information, internet activity, and approximate location with advertising partners. We do not use sensitive personal information to infer characteristics about you, and we do not knowingly sell or share the Personal Information of anyone under 16.

Residents of other U.S. states. If you live in a state with a comprehensive privacy law, such as Colorado, Connecticut, Oregon, Texas, or Virginia, you may have similar rights to access, correct, delete, and get a copy of your Personal Information and to opt out of targeted advertising. If we deny your request, you can appeal by emailing us with "Appeal" in the subject line.

If you live in the European Economic Area, the United Kingdom, or Switzerland, you have the right to access the Personal Information we hold about you and to ask that it be corrected, updated, or deleted. You may also restrict or object to our processing, receive a portable copy, withdraw consent at any time, and complain to your local data protection authority. We process your information to fulfill contracts with you (for example, when you place an order or book a stay), to pursue the legitimate business interests described above, to meet legal obligations, and with your consent where required. Your information will be transferred outside Europe, including to the United States and Canada.

How to make a request. Email info@o2treehouse.com or call (707) 204-0119. To opt out of targeted advertising, use our cookie banner or turn on Global Privacy Control. We will verify your identity before acting on requests to know, access, correct, or delete, and we will respond within 45 days. You may use an authorized agent, but we may ask for proof of their authority and ask you to verify your identity with us directly.

DATA RETENTION

We keep Personal Information only as long as we need it for the purposes in this Policy. We keep order and reservation records for up to 7 years for tax, warranty, and legal purposes; inquiries that do not become projects for up to 3 years after our last contact; newsletter information until you unsubscribe; and analytics data for up to 26 months. We may keep information longer if the law requires it or to resolve disputes. You can ask us to delete your information at any time, subject to these legal requirements.

SECURITY

We use reasonable safeguards to protect your Personal Information, including encrypted (HTTPS) connections, access controls, and trusted service providers. Payment card information is always encrypted in transit. No website is completely secure, so we cannot guarantee absolute security. If a breach affects your Personal Information, we will notify you as the law requires.

THIRD-PARTY LINKS

The Site links to and embeds content from other websites, including Instagram (@o2_treehouse and @treewalkers_world), Facebook, YouTube, X, and Google Maps. We are not responsible for their privacy practices, so please review their privacy policies.

The Site is not intended for children under 13, and our online store and booking site are intended for people 18 and older. We do not knowingly collect Personal Information from children under 13. If you believe a child has given us information, contact us and we will delete it.

CHANGES

We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons, and we will review it at least once a year. We will post the updated Policy here with a new "Last updated" date and, for significant changes, let you know by email or a notice on the Site.
